El sitio Sonico.com constituye un ámbito de comunicación e interacción destinado a los usuarios de Internet. Sonico.com encuentra concebido como una red social que facilita el contacto y conocimiento de las personas entre sí, a través de múltiples herramientas y servicios de comunicación puestos a disposición de sus usuarios.

En Sonico.com los usuarios podrán entre otras actividades: establecer contacto y compartir información de interés común con otros usuarios; enviar o fijar mensajes y comentarios; enviar postales o tarjetas electrónicas; utilizar servicios de alerta de fechas de interés. Podrán también los usuarios de Sonico.com acceder a contenidos tales como servicios, productos e información de distinto orden, provistos por el Sitio o terceros.

Las pautas para el uso de los servicios y la interacción de los usuarios dentro del sitio http://www.sonico.com o el “Sitio”, son dictadas exclusivamente por Sonico.com. Estas reglas tienen por finalidad recrear un ámbito seguro para las actividades de cada usuario, a la vez que garantizan un adecuado tratamiento a:

a) Los derechos de terceras personas.
b) El régimen de protección de los menores de edad.
c) El ordenamiento jurídico en su conjunto.

De esta forma, el acceso al Sitio, al igual que la utilización de los servicios en él incluidos, sólo se considerará autorizada cuando lo sea en cumplimiento de las pautas de uso dispuestas, con los límites y alcances delineados por Sonico.com, así como las que surjan de disposiciones complementarias o accesorias, y/o de las diferentes normativas legales de orden nacional e internacional cuya aplicación corresponda.

Las reglas dictadas por Sonico.com, y que todos los usuarios deben respetar, se encuentran establecidas y organizadas de diferente forma, integrándose en los siguientes documentos:

CONDICIONES GENERALES DEL SITIO”: son las disposiciones genéricas y obligatorias para todos los usuarios, rigen la totalidad de los servicios y comunicaciones que tengan lugar en Sonico.com.

POLÍTICA DE PRIVACIDAD”: tienen por objeto informar a los usuarios sobre cual es el tratamiento que Sonico.com da a la infamación de carácter personal.

CENTRO DE DENUNCIAS”: es una herramienta de comunicación con el Sitio. Mediante la misma cualquier persona podrá “denunciar” circunstancias existentes en el Sitio, que afectaran sus derechos.

“NORMAS DE UTILIZACION DE LOS SERVICIOS Y CONTENIDOS”: las normas establecen los requisitos y condiciones que deben cumplirse para la utilización de cada servicio y/o contenido en particular, las mismas podrán variar de un servicio a otro, y de acuerdo a las circunstancias personales de cada usuario.

Sonico.com, Inc. (“Sonico”) respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998, the text of which may be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, Sonico will respond promptly to claims of copyright infringement committed using the Sonico.com website (the “Services”) that are reported to the Sonico Designated Copyright Agent identified below.

If you are a copyright owner, authorized to act on behalf of one or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Services by sending Sonico a DMCA Notice of Alleged Infringement in the format provided below and delivering it to the Sonico Designated Copyright Agent. Upon receipt of Notice as described below, Sonico will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged use from the Services and/or termination of the Sonico user's account. Please note that in addition to being forwarded to the person who provided the allegedly infringing content, a copy of this legal notice may be sent to a third-party which may publish and/or annotate it. DMCA Notice of Alleged Infringement ("Notice")


To file a notice of infringement with Sonico, you must provide a written communication (by fax or regular mail -- not by email, except by prior agreement) that sets forth the items specified below. Please note that you will be liable for damages (including costs and attorneys' fees) if you materially misrepresent that a product or activity is infringing your copyrights. Indeed, in a past case (please see http://www.onlinepolicy.org/action/legpolicy/opg_v_diebold/for more information), a company that sent an infringement notification seeking removal of online materials that were protected by the fair use doctrine was ordered to pay such costs and attorneys fees. The company agreed to pay over $100,000. Accordingly, if you are not sure whether material available online infringes your copyright, we suggest that you first contact an attorney.

To expedite our ability to process your request, please use the following format (including section numbers):

1. Identify the copyrighted work that you claim has been infringed (for example, "The copyrighted work at issue is the text that appears on http://www.legal.com/legal_page.html"), or - if multiple copyrighted works are covered by this Notice - you may provide a representative list of the copyrighted works that you claim have been infringed.

DMCA Counter Notification

The process for counter notifications is governed by Section 512(g) of the Digital Millennium Copyright Act: http://www.copyright.gov/legislation/dmca.pdf When we receive a counter notification, we may reinstate the material in question. To file a counter notification with Sonico, you must provide a written communication that sets forth the items specified below.

Please note that under Section 512(f) of the Copyright Act, any person who knowingly materially misrepresents that a product or activity is not infringing the copyrights of others may be subject to liability (including costs and attorneys fees). Please also be advised that we enforce a policy that provides for the termination in appropriate circumstances of users who are repeat infringers. Accordingly, if you are not sure whether certain material infringes the copyrights of others, we suggest that you first contact an attorney.

Elements of Counter Notification

To expedite our ability to process your counter notification, please use the following format (including section numbers):

1. Identify the specific URLs of material that Sonico has removed or to which Sonico has disabled access.

2. Provide your full name, address, telephone number, and email address, and the username of your Sonico account.

3. Provide a statement that you consent to the jurisdiction of Federal District Court for the judicial district in which your address is located (or Los Angeles County, California if your address is outside of the United States), and that you will accept service of process from the person who provided notification under subsection (c)(1)(C) or an agent of such person.

4. Include the following statement: "I swear, under penalty of perjury, that I have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled."

5. Sign the notice. If you are providing notice by e-mail, a scanned physical signature or a valid electronic signature will be accepted.

What happens next?


After we receive your counter notification, we will forward it to the party who submitted the original claim of copyright infringement. Please note that when we forward the counter notification, it includes your personal information. By submitting a counter notification, you consent to having your information revealed in this way. We will not forward the counter notification to any party other than the original claimant.

After we send out the counter notification, the claimant must then notify us within 10 days that he or she has filed an action seeking a court order to restrain you from engaging in infringing activity relating to the material on Sonico. If we receive such notification we will be unable to restore the material. If we do not receive such notification, we may reinstate the material.

Account Termination

Sonico will, in appropriate circumstances, terminate repeat infringers. If you believe that an account holder or subscriber is a repeat infringer, please follow the instructions above to contact Sonico and provide information sufficient for us to verify that the user is a repeat infringer.
